On Friday, the administration filed an emergency request to the federal top court, asking for authorization to send military reserve troops to the state of Illinois.

This step is part of a broader effort to widen the internal deployment of the armed forces in several urban centers under Democratic control.

Court Fight Over Troop Deployment

In an immediate request, the US Department of Justice asked the bench to reverse a previous judicial decision that had halted the deployment of hundreds of military reserve personnel to the Chicago region.

The federal judge had expressed skepticism about the government's explanation for activating the guard, doubting its explanation in considering regional circumstances.

A higher court supported the previous order on Thursday, maintaining the deployment on pause while the judicial dispute moves forward.

Government's Claims

The federal legal representative, representing the administration, claimed in the new filing that federal law enforcement have frequently been “menaced and attacked” in the city of Chicago and the suburb of Broadview.

This site is home to an ICE detention facility.

The former president has already dispatched military reserve units to Chicago, Illinois and Portland, Oregon, subsequent to prior sendings to Los Angeles, the city of Memphis, and the nation's capital.

The president has argued that military intervention is necessary to curb unrest and strengthen border control.

Partisan Opposition

Democratic officials have strongly opposed the action, arguing that the administration's assertions are inflated and driven by politics.

They charge the former president of misusing his authority to target political rivals.

The judiciary have also expressed doubt about the government's portrayal of the situation.

Local leaders claim that protests over immigration enforcement have been mostly limited and peaceful, contradicting the former president's description of “combat area” conditions.

Jurisdictional Framework

At the heart of the dispute is the president’s use of a US code authorizing the commander-in-chief to nationalize the military reserve only in instances of rebellion or when “incapable with the regular forces to enforce the regulations of the US”.

The administration argues that the personnel are essential to safeguard government buildings and personnel from protesters.

Recent Actions

In recent weeks, the administration took control of several hundred personnel of the Illinois national guard and directed more Texas-based personnel into the Illinois.

As city officials criticized the action, the former president increased his statements, urging the detention of the city's leader and the Illinois governor, each a Democrat, accusing them of neglecting to protect ICE personnel.

Illinois and Chicago filed a combined lawsuit the administration to halt the deployment.

On the ninth of October, district Judge April Perry, a Biden appointee, issued a temporary injunction stopping the command.
